House Rules

§ 1 GENERAL PROVISIONS 
 

1. AREAS OF USE
FIREBALL Freizeit-Einrichtungen GmbH & Co. KG ("OPERATOR") provides members and guests ("USERS") with the facilities of the KAIFU LODGE fitness center and, for an extra fee, squash courts and the therapy area.


The additional facilities provided, in particular childcare, outdoor and indoor swimming pool, sunbathing lawns, sauna and rest areas and heat bank, as well as showers and changing rooms, are to be understood as a free additional service. The limited use of these facilities or their partial or complete closure, for whatever reason, entitles neither to a reduction in price nor to cancellation.

The aforementioned facilities are hereinafter collectively referred to as "USE AREAS". Any use is at the risk of the USER.

 

2. AUTHORIZATION OF USE
Each USER must be in possession of a valid access authorization (FITNESS CLUB CARD, FITNESS DAY TICKETS; SQUASH&FITNESS CARD; SQUASH CLUB CARD; SQUASH DAY BOOKER CARD, collectively referred to as "CARD") for the respective area used. The CARD must be kept carefully and must be carried with you each time you visit KAIFU LODGE. Without a CARD, access to the USED AREAS may be denied.  The CARD is not transferable to other persons. Transferring the CARD to a third party may result in termination of membership. In case of loss or damage of the CARD a fee of € 10 has to be paid. This does not cover any credit that may have been used with the CARD.


Admission is not permitted to persons, among others:                                                                                   

- who are under the influence of intoxicating substances
- who have animals with them.

Special conditions and opening hours apply to children and young people (see §1; point 5).

 

3. BINDING NATURE 
The House Rules and Regulations are binding for all USERS of the USE AREA according to paragraph 1. With the acquisition of the access authorization, every USER accepts the house rules and regulations as well as the instructions of the KAIFU-LODGE employees and all other regulations for a safe and orderly operation. In case of violation the OPERATOR is entitled to ban the user from the house.

5. DRESS
Appropriate clothing must be worn at all times. This also applies to therapeutic treatments and massages. In the fitness and squash area, suitable sports clothing (training pants, sports shirt or tracksuit) and clean sports shoes with light-colored soles must be worn. For damages caused by dark soles or dirty shoes, the USER can be held liable by the OPERATOR. Appropriate swimwear must be worn in the swimming pool. The sauna is a textile-free zone, please do not wear swimwear there. Entering the swimming / sauna area with sports or street shoes is prohibited. 

 

6. CHILDREN / YOUTHS

 

6.1 Family opening hours
Children 12 years of age and younger are permitted access to the KAIFU-LODGE when accompanied by a parent/guardian/user. However, access is limited to the swimming pool area in addition to the children's area/children's classes (10am-8pm). Children and adolescents from 12 to 16 years of age may enter the KAIFU-LODGE only when accompanied by a parent/guardian user if an appropriate day pass is purchased. Use of the equipment area and the courses is not possible under any circumstances. Adolescents from 16 years of age are entitled to use the USE AREAS 10 a.m. to 10 p.m. even without being accompanied by a parent/guardian if the conditions of 6.3 are met. 

 

6.2 Courses for children and teenagers
For children aged 0 to 16 years, there is the possibility to participate in the Kids & Teens courses. Participation is subject to a fee. Registration at the reception is always required. The current range of courses and the respective valid prices can be obtained at the reception.

 

6.3 Membership
Young people from the age of 16 are entitled to apply for membership in the KAIFU-LODGE (FITNESS CLUB CARD), provided that the consent of the KAIFU-LODGE management has been obtained and the written consent of their parents has been obtained and provided that the parents themselves are in possession of a valid FITNESS CLUB CARD. The validity of the FITNESS-CLUB CARD for young people over 16 years of age is limited from the outset to the period of validity of the FITNESS-CLUB CARD of their parents.

 

6.4 Childcare
USERS can use the childcare for their children between the ages of runnable and 6 years free of charge. The presence of a parent/guardian in the USE AREAS is required at all times during the childcare hours. 

Childcare capacity is limited to approximately 10 children per caregiver. 

The OPERATOR reserves the right, in order to protect the health of all children in care, not to admit children in the event of illness. This is especially true in the case of contagious childhood diseases such as mumps, measles, rubella, whooping cough, or in the case of infectious symptoms such as gastrointestinal virus or scarlet fever. 

It is ultimately up to our caregivers to decide whether or not they can care for a child.

 

7. FOUND PROPERTY
Lost property must be handed in at the reception. No responsibility can be taken for lost property.

 

8. SMOKING
Smoking is only allowed in the designated areas. Smoking is strictly prohibited in all other areas.

 

9. FOOD AND BEVERAGES
Drinks in glass containers may only be consumed in the catering area or in the designated area of the swimming area (gallery). In the sports areas drinks are allowed only in plastic bottles.

The consumption of brought food in the KAIFU-LODGE is prohibited.

 

10. CHANGES
The OPERATOR reserves the right to update the House Rules and Regulations as needed. A change does not entitle the USER*S to a reduction or withdrawal.

 

 

§ 2 SPECIAL PROVISIONS
 

1. FITNESS AREA
The use of the equipment can only take place after instruction by the designated staff. The OPERATOR reserves the right to hold the USER liable for any costs incurred in the event of improper use and resulting damage. Used equipment and objects are to be put back in their designated place after use.

For hygienic reasons, a towel is to be taken along for each equipment and course training session and placed on the seating and lying areas of the equipment or sports mats. 

Every member is free to participate in the courses, but the number of participants in the courses is limited for safety reasons. Registration is required for individual courses. Registrations are accepted by the designated staff members. Registrations will be considered in the order in which they are received. Please arrive on time for all classes.

Classes are offered for different fitness levels. Participants are encouraged to select appropriate classes based on their fitness level. 

Sports bags are not allowed in the fitness area. 

The instructions of the trainers and course instructors must be followed. Violations will result in a ban from the premises.

2. SQUASH
Squash courts can be booked at the reception for an extra fee. Individual squash bookings are accepted by phone or verbally. Individual squash bookings can be made 7 days in advance. Permanent bookings require written confirmation by the OPERATOR. The OPERATOR reserves the right to change the assigned court number in individual cases for internal reasons or, if the assignment of another court is not possible, to use assigned courts for special purposes (tournaments, repairs, etc.) against credit of the court rent.

The fee for the squash booking must be paid in advance at the reception. The basis for this is the respectively valid price list, which can be found on the notice board in the KAIFU-LODGE. The OPERATOR is entitled to adjust the prices at any time.

Cancellation of single squash bookings is only possible up to 24 hours before the playing date. If a booking is returned within 24 hours, the fee will be waived in case of a new rental. 

One squash hour lasts 45 minutes. Decisive for the change is the clock located in front of the courts. It is not permitted to continue playing even on courts that happen to be free beyond the booked time. For each additional 45 minutes or part thereof, the OPERATOR is entitled to charge a full fee.

The fee for a squash booking includes the use of the court by two players. If additional players participate in a booking, they will have to pay an additional half court fee per person.

The player is liable for all damages caused by him or by fellow players invited by him to the property of the OPERATOR. For broken rental rackets a replacement amount of € 5,00 will be charged, in case of loss of the racket € 10,00.

 

3. SAUNA / SWIMMING POOL
The use of bathing shoes is recommended for hygienic reasons. Showering is required before using the sauna and swimming area. Shaving is not permitted in the entire wet area. Please note that cuts could be a health risk. In the sauna and when using the loungers, a sufficiently large towel must be placed underneath. It is forbidden to cover the loungers with towels. The staff is authorized to remove towels from unused loungers. Please do not disturb other guests by excessive noise.

   

Please also note the following points for the swimming area:

- Do not jump from the edge of the pool.
- Glass / glasses is / are not allowed in the wet area
- Eating / food is / are not allowed in the wet area
- Please do not use balls, snorkels, flippers and/or inflatable toys outside of aqua classes.
- With the exception of the non-swimmer pool, it is prohibited to be in the pools unless supervision by a lifeguard* is provided.

Please also note the following for the sauna area:

- Glass containers are not permitted in the entire sauna area.
- Food / meals are not allowed in the sauna area
- No entertainment of any kind is permitted in the quiet sauna area
- USERS suffering from high blood pressure or cardiovascular problems, as well as expectant mothers, should consult a doctor before using the sauna. 
- Children and teenagers under 14 years of age may use the sauna only when accompanied by a parent or guardian.
- The posted sauna rules must be observed.

In all other respects, the bathing regulations of Bäderland GmbH apply to the swimming pool and the sauna area of Bäderland GmbH. The USER is obligated to comply with the same. Supervision in the swimming pool/sauna area operated by Bäderland GmbH (e.g. by lifeguards) is not guaranteed by the OPERATOR: 

Violations entitle to immediate expulsion. 

 

4. CHANGING ROOMS 
Lockable lockers for clothing and bags are located in the locker rooms. We ask that items brought to the locker room always be placed in a locked locker. Care must be taken to keep locker keys in a safe place. Please use the option of wearing the locker keys as a wristband. If the locker key is lost, a fee of € 20.00 will be charged. The OPERATOR cannot be held responsible for lost valuables and damages.

The lockers are to be emptied after use and left unlocked. The storage of items in the lockers overnight is not permitted. The lockers will be checked and emptied - there is no obligation on the part of the OPERATOR to return them.

After showering, the changing rooms may only be entered after drying off.

 

5. PARKING PLACE
The use of the parking lot is at your own risk. The OPERATOR assumes no liability for this. Winter maintenance is limited on the access roads and sidewalks. Vehicles may only be parked by USERS* of the USE AREAS of KAIFU LODGE for the duration of use. Bicycles, mopeds and the like are to be parked in the spaces provided for this purpose. Unauthorized parked vehicles as well as vehicles that are not parked in the designated parking zones will be removed with costs.

 

§ 3 LIABILITY

Entering the AREAS OF USE including access roads, parking lot and outdoor area as well as the use of all equipment and the aforementioned AREAS OF USE and participation in the courses is at the USER'S*INNER'S* own risk. The same applies to the childcare and children's courses offered by the OPERATOR. In particular, the OPERATOR is not liable for the loss of valuables, even if they were included.

Excluded from this limitation of liability is the liability for damages resulting from injury to life, body or health as well as guarantees or claims under the Product Liability Act. Furthermore, liability for the breach of obligations, the fulfillment of which makes the proper execution of the contract possible in the first place and on the compliance with which the customer may regularly rely (cardinal obligations), shall remain unaffected. The same applies to breaches of duty by the legal representatives and/or vicarious agents of the OPERATOR. In all other respects, the pre-contractual, contractual and non-contractual liability of the OPERATOR of its legal representatives and/or vicarious agents is limited to intent and gross negligence. The liability is basically limited to the amount of the liability insurance sum taken out by the OPERATOR, as far as the law does not prescribe a mandatory further liability.

Insofar as the OPERATOR is liable within the scope of the aforementioned limitations of liability for damages in the area of the swimming and sauna area operated by Bäderland GmbH, the liability is limited to the amount of the liability insurance sum taken out by the OPERATOR, but at most to the maximum compensation limit according to the bathing regulations of Bäderland GmbH, insofar as the law does not stipulate any mandatory further liability.
